Last number of Juridica published Law Firm ALTERNA’s lawyer Kristena Paalmäe’s article „The right to data portability in the General Data Protection Regulation“.

Right to data portability, established by Article 20 of GDPR, gives data subjects the right to receive their personal data from a controller, to transmit the data to another controller by themselves or ask the controller to directly transmit their personal data to another controller.

It is a completely new concept in European Union data protection law, which the former Directive 95/46/EC did not include. Therefore, it is important to be aware about the rights and obligations it entails to data subjects and data controllers. 

Kristena’s article answers the main questions about exercising the right to data portability: what are the conditions of the right to data portability, what are the data controller’s obligations and when can the data controller refuse the data subject’s request on data portability.
